These Terms and Conditions ("Terms") govern your use of the Harmonia Path website at harmoniapath.com, the Harmonia Path mobile application, and all related services, courses, and digital products (collectively, the "Service") operated by Harmonia Path SRL ("we," "us," or "our"), a company registered in Romania at Str. Soporului, nr. 8, bl. A2, sc. 3, et. 2, apt 137, Cluj-Napoca, jud. Cluj, Romania.

By accessing or using our Service, creating an account, or purchasing any of our products, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Our Service is intended for individuals aged 18 and older. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the Service, create an account, or purchase any products.

  • You will immediately discontinue the program and seek medical attention if you experience any adverse symptoms, discomfort, pain, dizziness, nausea, or any other concerning physical or psychological effects

Any testimonials, case studies, or success stories shared on our website, app, or marketing materials represent individual experiences and should not be interpreted as typical or guaranteed results.

 

3.5 Limitation of Liability for Health Outcomes

To the maximum extent permitted by applicable law, Harmonia Path SRL, its owners, employees, agents, and affiliates shall not be held liable for any health-related damages, injuries, adverse effects, illness, or death arising from or in connection with your use of our programs, your reliance on information provided in our programs, or your decision to change your diet based on information in our programs.

You agree to hold harmless and indemnify Harmonia Path SRL against any claims, damages, losses, or expenses arising from your participation in our programs.

 

4. Products and Services

4.1 Digital Courses

We offer the following digital products:

  • 21 Days to Food Freedom — A 3-week educational program focused on understanding and managing food cravings and one's psychological relationship with food.
  • Return to Your Natural Self — A dietary education program focused on teaching a nutritional approach to weight management through adjustments to food choices and eating patterns.

Both programs are delivered digitally through text and audio format via the Kajabi platform and the Harmonia Path mobile app.

 

4.2 Mobile Application

The Harmonia Path app is available on the Google Play Store and Apple App Store. The app provides access to purchased course content, as well as free features including the Food Journal. Certain features require an account and an active course purchase.

 

4.3 Content Accuracy

While we strive to ensure our content is accurate, well-researched, and up to date, we do not warrant that the information in our programs is complete, current, or error-free. The field of nutrition and health is constantly evolving, and information that is current today may be revised or updated in the future. We reserve the right to update, modify, or correct our course content at any time.

 

5. Account Registration and Security

5.1 Account Creation

To access purchased course content, you must create an account on our platform. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.

 

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account.

 

5.3 One User Per Account

Each purchase grants access to one individual only. You may not share your account credentials, course access, or any course materials with any other person. We reserve the right to terminate accounts that we reasonably believe are being shared with or used by multiple individuals.

 

6. Purchases and Payments

6.1 Pricing

All prices are displayed in US Dollars (USD) at the time of purchase. We reserve the right to change our prices at any time. Price changes will not affect purchases already completed.

 

6.2 Payment Processing

Payments are processed securely by our third-party payment providers, Stripe and PayPal. By making a purchase, you agree to the terms of service and privacy policies of the applicable payment provider. We do not store your payment card details on our systems.

 

6.3 Access After Purchase

Upon successful payment, you will receive access to the purchased course content. Access is granted for the lifetime of the Service, meaning you may continue to access the course content for as long as we continue to operate the Service and the platform on which it is hosted remains available.

"Lifetime access" refers to the lifetime of the product and Service, not the lifetime of the user. While we intend to maintain the Service for the foreseeable future, we cannot guarantee perpetual availability. Should we ever discontinue the Service, we will provide reasonable notice and, where practicable, offer users the opportunity to download or retain their course materials.

 

7. Refund Policy

7.1 21 Days to Food Freedom

We offer a 14-day money-back guarantee on the "21 Days to Food Freedom" course. If you are unsatisfied for any reason, you may request a full refund within 14 days of your purchase date. No questions asked.

 

7.2 Return to Your Natural Self

We offer a 30-day money-back guarantee on the "Return to Your Natural Self" course. If you are unsatisfied for any reason, you may request a full refund within 30 days of your purchase date. No questions asked.

 

7.3 How to Request a Refund

To request a refund, send an email to [email protected] with your name, the email address used for your purchase, and the name of the course you wish to be refunded for. Refunds will be processed within 14 business days of receiving your request and will be issued to the original payment method.

 

7.4 After a Refund

Upon processing a refund, your access to the refunded course content will be revoked. If you accessed course content through the mobile app, the associated course features will be deactivated. Free features of the app, such as the Food Journal, will remain available.

 

8. Intellectual Property

8.1 Ownership

All content included in our courses, website, and app — including but not limited to text, audio, images, graphics, design, logos, and the Harmonia Path brand — is the property of Harmonia Path SRL and is protected by copyright and other intellectual property laws.

 

8.2 Limited License

Upon purchasing a course, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the course content for your personal, non-commercial educational purposes only.

 

8.3 Restrictions

You may not:

  • Copy, reproduce, distribute, or share any course content with any third party
  • Screenshot, record, download (except where explicitly provided), or capture course content by any means
  • Modify, adapt, translate, or create derivative works based on the course content
  • Use the course content for any commercial purpose, including reselling, republishing, or incorporating it into your own products or services
  • Remove, alter, or obscure any copyright or proprietary notices contained in the course content

Any unauthorized use of our content constitutes a violation of these Terms and applicable intellectual property laws, and may result in the immediate termination of your account and access without refund.

 

9. User Conduct

By using our Service, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or entity

10. App-Specific Terms

10.1 Local Data Storage

Certain features of the app, including the Food Journal and course tools, store data exclusively on your device. This data is not backed up to our servers. You are solely responsible for your locally stored data. If you delete the app, clear its data, or change devices, locally stored data will be permanently lost and cannot be recovered by us.

 

10.2 Free Features

The Harmonia Path app includes free features, such as the Food Journal, that are available without a course purchase. While we intend to keep these features free, we reserve the right to modify, update, or change the availability of free features at any time.

 

10.3 App Updates

We may release updates to the app from time to time. While we encourage you to keep the app updated for the best experience, we are not obligated to provide updates, maintenance, or support for any specific version of the app.

 

10.4 Third-Party App Stores

The app is distributed through the Google Play Store and Apple App Store. Your use of the app is also subject to the terms and policies of the applicable app store. In the event of a conflict between these Terms and the app store terms, these Terms shall prevail to the extent permitted.

 

11. Future Features and Services

We may introduce new features, services, or subscription offerings in the future. Any new features that involve additional data collection or processing will be governed by updated Terms and our Privacy Policy, and will require your explicit consent before activation. You will never be required to use optional features in order to access the core Service you have purchased.

 

12. Termination

12.1 Termination by You

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service, without prior notice and without refund, if we reasonably believe that you have violated these Terms, including but not limited to sharing account access, distributing course content, or engaging in abusive or fraudulent behaviour.

 

12.3 Effect of Termination

Upon termination, your right to access the Service and all course content will cease immediately. Sections of these Terms that by their nature should survive termination shall continue to apply, including but not limited to Sections 3 (Health and Medical Disclaimer), 8 (Intellectual Property), 13 (Limitation of Liability), 14 (Indemnification), and 16 (Governing Law).

 

13. Limitation of Liability

13.1 General Limitation

To the maximum extent permitted by applicable law, Harmonia Path SRL, its owners, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, health, use, goodwill, or other intangible losses, arising out of or in connection with:

  • Your use of or inability to use the Service
  • Any content or information obtained through the Service
  • Unauthorized access to or alteration of your data
  • Any dietary or lifestyle changes you make based on information in our programs
  • Any health outcomes, adverse effects, or injuries resulting from your participation in our programs
  • Any other matter relating to the Service

 

13.2 Maximum Liability

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

 

13.3 Disclaimer of Warranties

The Service, including all courses, content, and app features, is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

 

14. Indemnification

You agree to defend, indemnify, and hold harmless Harmonia Path SRL, its owners, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any dietary or lifestyle changes you make based on information obtained through our Service
  • Any health-related claims arising from your participation in our programs
  • Any content or information you submit through the Service

 

15. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes that significantly affect your rights or obligations, we will notify you by email or through a notice within the app.

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

 

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

 

16.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cluj-Napoca, Romania.

 

16.3 Amicable Resolution

Before initiating any legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute amicably. We will make reasonable efforts to resolve any disputes within 30 days of receiving your written notice.

 

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

 

18. Entire Agreement

These Terms, together with our Privacy Policy (available at harmoniapath.com/privacy-policy), constitute the entire agreement between you and Harmonia Path SRL regarding your use of the Service, and supersede all prior agreements, communications, and understandings, whether written or oral.

 

19. Waiver

The failure of Harmonia Path SRL to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Harmonia Path SRL.
